What is "Smile Service"?

Smile Service Corporation is located in Otakibashi street,NishiShinjuku builing 1F,7-10-9 NishiShinjuku,SHinjuku ward,Tokyo.They mainly advertise and have contracts on one room apartment.They have several fancy pink advertising display along JR Chuo-line so you might have seen them.
This company is doing very good at the moment.And no wonder because the initial cost to get in their apartments is very cheap.Normally you would expect to pay deposit and "Thank you money" and even proceeding fee.But this company does not take these money from you to move in ,also no guarantor is needed.
On the other hand,this company has been doing bad things that are unforgivable.
In short, they makes it easy to move in to the apartments, with contracts unfavorable to consumers which they act unlawfully with as they wish.

Extraordinary contract

Let us sum up the contract of Smile Service corporation.

• You may be kicked out of your apartment If your rent comes later than day after the due.
• You have to pay penalty If your rent comes later than day after the due.
• You may be kicked out of your apartment if you don't put the trash out properly.
• If the management company goes in to your room,they may throw out your remaining stuff.
• When a conflict occurs,the tenant can not sue the company.

This is unspeakable matter.They ignore the housing rights,right to life and dignity of the tenants.Most of these contract will be invalid under the Japanese consumer law, Paragraph 10 which order to make any terms only unfavorable to consumers invalid,even if you have officially singed the contract. Also The Section 2 of Paragraph 9 of the same law sets the upper limit of penalty therefore the penalty system employed by Smile Service will be invalid,too.And of course it is definitely unfair to be forced to sign these kind of contract.
Smile service is different from the rest because they treat the contract not as rental contract but as contract on temporal use of keys.They aim to get away with Land and House Rental Law which is known to protect the tenants than the landlords.The legal judgement on these issue is still ambiguous but it is very likely that what Smile Service is doing is illegal.

Taking advantage of you

Many of who use Smile Service because of the low initial cost are socially vulnerable persons such as "Freeters",non-Japanese,or people who has lost their jobs.They take advantage of people with less information and bargaining power and take the profit they normally would not get.They think people who come to them won't resort to legal action.Because they believe that they behave terribly wrong .
